1. Acceptance of Terms

By accessing or using PID AI Chat ("the Platform"), operated by Portugal Immigration Diaries, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Platform. These terms apply to all users, including businesses, team members, and administrators.

2. Description of Service

PID AI Chat is a WhatsApp Business automation platform that provides tools including AI chatbots, visual flow builders, broadcast messaging, a shared team inbox, CRM pipeline management, and commerce integrations. The Platform operates through the official WhatsApp Business API provided by Meta.

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old or the legal age in your jurisdiction to use the Platform.
• One WhatsApp Business number may only be connected to one PID AI Chat account at a time.

4. Acceptable Use

You agree not to use the Platform to:

• Send unsolicited spam or bulk messages in violation of WhatsApp's Business Policy or Commerce Policy.
• Transmit harmful, abusive, defamatory, or illegal content.
• Impersonate another person or entity.
• Attempt to reverse-engineer, exploit, or interfere with the Platform's infrastructure.
• Violate any applicable local, national, or international law.

5. WhatsApp API and Meta Compliance

The Platform operates through Meta's WhatsApp Business API. You are responsible for complying with Meta's policies including the WhatsApp Business Policy, WhatsApp Commerce Policy, and Meta's Terms of Service. Any violations of Meta's policies may result in suspension of your WhatsApp Business account by Meta, which is outside our control.

6. Billing and Payments

• PID AI Chat charges a subscription fee for platform access. Pricing details are available on our website or upon request.
• WhatsApp conversation charges are billed separately by Meta based on their per-conversation pricing model. These charges are your responsibility.
• Subscriptions are billed on a recurring basis. You may cancel at any time, but no refunds are provided for the current billing period.
• We reserve the right to change pricing with 30 days' prior notice.

7. Intellectual Property

All content, features, and functionality of the Platform (including design, code, logos, and documentation) are owned by Portugal Immigration Diaries and are protected by intellectual property laws. You retain ownership of your data and content uploaded to the Platform.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including Meta/WhatsApp API outages). We are not liable for any losses arising from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, PID AI Chat and Portugal Immigration Diaries shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms, engage in prohibited activities, or fail to pay applicable fees. Upon termination, your right to use the Platform ceases immediately. You may request export of your data within 30 days of termination.

11. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Portugal.
